Advice and Comments

PC 203

To avoid a COV, and therefore a deportable crime of DV, see PC 69, 136.1(b), 148, 236/237, 243(a), (d), (e), 243.4, 591, 594. Some of these offenses (236/237, 591, 594) can take a sentence of a year or more. See PC 207 for more on crimes of violence. See § N.4 Sentence.

SB54: Law enforcement is permitted to notify/transfer to ICE indefinitely. See SB 54 advisory at www.ilrc.org/crimes-summaries.

Mandatory Detention: As a straight felony CIMT, PC 203 will trigger mandatory detention for people who have not been admitted. Those who have been admitted may also be subject to MD if they are deportable for certain crimes. See advice on Mandatory Detention.
